The Commercial High Court of the Western Province (Exercising Civil Jurisdiction), seated in Colombo, has granted an enjoining order and interim injunction in Case No. CHC 08/2026/IP, concerning a trademark infringement dispute relating to the brand name “Garsy.”
The plaintiff, the registered owner of the trademark “Garsy,” has been using the brand name in relation to its products since 2024. The plaintiff informed the Court that the defendant had begun marketing similar products under the brand name “Garcy,” which is phonetically similar to the plaintiff’s registered trademark.
Submissions made on behalf of the plaintiff further stated that the plaintiff had obtained all necessary approvals from relevant authorities, including the Ayurvedic Department, whereas the defendant had allegedly failed to secure such approvals for their products.
It was also submitted that the defendant had used advertisements similar to those of the plaintiff, potentially affecting the goodwill and reputation of the plaintiff’s brand. The defendant is further alleged not to have registered the disputed trademark.
Upon considering the submissions, pleadings, and documents tendered, the Court granted an enjoining order restraining the defendant for a period of 14 days, as prayed for in the plaint.
