Supreme Court to consider Rajitha Senaratne's petition for recount of preferential vote

The Supreme Court has scheduled the Fundamental Rights (FR) petition filed by former Minister Rajitha Senaratne for consideration on September 30, 2025. The petition seeks a recount of preferential votes obtained by New Democratic Front (NDF) candidates in the Kalutara District during the 2024 General Election.

A three-member bench comprising Justices Preethi Padman Surasena, Janaka de Silva, and Sampath B. Abeykoon made the decision today (06). The Election Commission, its Chairman, the Kalutara District Returning Officer, MP Rohitha Abeygunawardena, and the Attorney General have been named as respondents.

Senaratne claims irregularities in the vote-counting process prevented his election to Parliament, highlighting a margin of just 119 votes between him and the elected MP. He has requested the court to declare a violation of his fundamental rights and to order a recount and revision of the results.

Attorney-at-Law Keerthi Thilakarathne and President’s Counsel Faisz Musthapha represented the petitioner.
