Court lifts injunction on Wimal’s book; Tilvin to get Rs.1mn compensation

The Supreme Court dismissed an appeal filed by former Minister Wimal Weerawansa against an order issued by the Colombo Commercial High Court.
The court directed him to pay a compensation of one million rupees to Janatha Vimukthi Peramuna General Secretary Tilvin Silva for violating his intellectual property rights through certain documents included in the book titled 'Natta Venuvata Attha' authored by Wimal Weerawansa.
The Supreme Court judgment stated that the injunction issued by the Commercial High Court preventing the publication, sale, and distribution of the relevant book will be subject to modifications.
Accordingly, the judgment declared that the relevant injunction limits only to the documents of respondent Tilvin Silva included in the book.
Supreme Court Judge Shiran Gooneratne announced this decision with the agreement of Supreme Court Judges Janak de Silva and Sampath Abeykoon.
Janatha Vimukthi Peramuna Secretary Tilvin Silva filed a case before the Commercial High Court stating that Wimal Weerawansa included a number of Janatha Vimukthi Peramuna documents when publishing the relevant book, thereby violating his intellectual property rights.
The Colombo Commercial High Court, which examined the case, ordered Wimal Weerawansa to pay a compensation of one million rupees to Tilvin Silva as the intellectual property rights of complainant Tilvin Silva faced violation through this.
Wimal Weerawansa presented this special appeal to the Supreme Court against that decision.
